Premarital Agreements

Although we all hope you never get divorced, and that your marriage is a happy-ever-after story, more and more people are using premarital agreements.  These agreements are designed to help couples define property rights prior to marriage so that, in the event of a divorce, less time and money needs to be spent on arguing about "who gets what" and how assets and debts will be allocated.

It is important for Texas residents to remember that a strong presumption applies that marital property is community property at the time of a divorce.  This means that the property is subject to a "just and right" division at the time of divorce.  A proper premarital agreement can help to preserve property that a spouse owned prior to marriage or which is otherwise defined as that spouse's separate property in the agreement.
